1. Agreement to Terms

These Terms & Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Seerat Logestics Inc. ("Company," "we," "us," or "our"). Your access to and use of the Seerat Logestics and any associated services (collectively, the "Service") is conditioned on your acceptance of and compliance with these Terms.

• Capture and submit vehicle pre-start inspections
• Complete and manage dockets
• Log working hours and activities
• Receive work-related notifications and updates

2.3 Prohibited Uses

You agree NOT to:

• Modify, reverse engineer, or attempt to reverse engineer the app
• Use the app for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe upon the rights of others (intellectual property, privacy, etc.)
• Transmit viruses, malware, or any code that harms the app
• Attempt to gain unauthorized access to the app or its systems
• Upload or transmit harassment, obscene, defamatory, or offensive content
• Impersonate others or provide false information
• Interfere with the app's operation or other users' use
• Sell, lease, assign, or sublicense the app or your license
• Use the app while operating a vehicle illegally or unsafely
• Disable location tracking or provide false location data intentionally

3. User Responsibilities

3.1 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information during registration
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• You agree to change your password regularly and keep it secure

3.2 Safe and Legal Use

• You must comply with all traffic laws and regulations while using the app
• You agree not to use the app while distracted or in a manner that endangers others
• You are responsible for any accidents, citations, or legal issues arising from app use
• You must follow all employment and operational rules set by your employer
• You agree to use the app in accordance with all applicable laws

3.3 Data Accuracy

• You must ensure all information you provide is accurate and truthful
• You must update your profile information as needed
• You are responsible for the accuracy of shift logs and docket information

4. Intellectual Property Rights

4.1 Company IP

The Seerat Logestics, including all content, features, functionality, design, graphics, text, and code, is owned by Seerat Logestics Inc. or its licensors. All intellectual property rights are reserved. Nothing in these Terms grants you any ownership or rights to the app or its content.

4.2 User Content

You retain ownership of any photos, messages, and data you upload ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content for operational, analytical, and improvement purposes.

4.3 Trademarks

All logos, trademarks, and service marks displayed in the app are the property of Seerat Logestics Inc. or their respective owners. Unauthorized use is prohibited.

5. Service Limitations and Changes

5.1 Service Availability

• We strive to provide continuous service but make no guarantee of uninterrupted availability
• The app may be temporarily unavailable for maintenance, updates, or repairs
• We may modify or discontinue features without prior notice
• Service quality may vary based on device, network, and environmental conditions

5.2 Updates and Modifications

We may update the app, features, or functionality at any time. Updates may require you to accept new terms or conditions. If you do not accept updates, you may not be able to continue using the app.

5.3 Location Services Limitations

• GPS accuracy varies and may be affected by signal obstruction, weather, or location
• We do not guarantee continuous or accurate location tracking
• Users are responsible for ensuring mobile data or WiFi connectivity

6. User Conduct and Content Standards

6.1 Prohibited Content

You agree not to upload, transmit, or display:

• Pornographic, explicit, or adult content
• Content that promotes violence, discrimination, or hatred
• Harassment, bullying, or threatening content
• Defamatory, libelous, or slanderous content
• Confidential or proprietary information without authorization
• Content that violates others' privacy or intellectual property

6.2 Consequences of Violations

We reserve the right to remove content and terminate accounts of users who violate these standards. Violations may result in:

• Suspension of account access
• Permanent termination of account
• Legal action if applicable

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE DRIVER APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS

We do not warrant that the app will meet your requirements, be error-free, or uninterrupted. Your use of the app is at your own risk.

7.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DRIVER APP INC. BE LIABLE FOR:

• DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS
• EMOTIONAL DISTRESS OR REPUTATIONAL HARM
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3 YOUR SOLE REMEDY

Your exclusive remedy for dissatisfaction with the app is to discontinue use and uninstall it.

8. Third-Party Links and Services

The app may contain links to third-party websites and services. We are not responsible for:

• The content or accuracy of third-party sites
• Privacy practices of third parties
• Your interactions with third-party services
• Any damages resulting from third-party content or services

Use of third-party services is at your own risk and governed by their terms and conditions.

9. Indemnification

You agree to indemnify, defend, and hold harmless Seerat Logestics Inc., its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, or expenses arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any laws or regulations
• Your infringement of others' rights
• Your User Content or submissions

10. Termination

10.1 Termination by User

You may terminate your account at any time by uninstalling the app or contacting support.

10.2 Termination by Company

We may terminate or suspend your account immediately if you:

• Violate these Terms or any applicable laws
• Engage in harassment or abusive behavior
• Attempt to gain unauthorized access
• Provide false or fraudulent information
• Violate intellectual property rights
